Judge shouldn't let prosecutors hide in freeway shooting case

  Sadly Arizona Department of Public Safety Director Frank Milstead seems to be a patholotical liar just like Maricopa County Attorney Bill Montgomery.

Sadly Maricopa County Attorney Bill Montgomery routinely does this rubbish when he arrests medical marijuana patients and medical marijuana care takes on imaginary laws.

Roberts: Judge shouldn't let prosecutors hide in freeway shooting case

It’s time to let us in on why Leslie Merritt Jr. is a free man today.

More specifically, on why police and prosecutors were able to jail this 21-year-old father – a man with no criminal record – for SEVEN MONTHS before suddenly asking on Friday that those charges be dismissed.

What ...oops?

Never mind?

Sorry, don’t think so.

Merritt’s attorneys on Tuesday asked Maricopa County Superior Court Judge Warren Granville to unseal court documents in the case – the ones that led him to dismiss all charges on Monday.

Defense attorneys have hinted that the prosecution’s Lucien Haag – a nationally recognized expert in ballistics – determined that none of the bullets in Merritt’s gun matched any of the bullets found in last year’s freeway shootings.

That would be curious, given that Arizona Department of Public Safety Director Frank Milstead has insisted that Merritt’s gun was tied to four of the 11 shootings last summer, most of them along Interstate 10.

Granville sealed the material early on, apparently due to a concern about tainting a jury pool.

Given that there now will be no jury, it seems reasonable that the public should be able to see how police and prosecutors wielded their rather awesome power in this case.

Doesn't it?

Or will DPS and prosecutors be allowed to hide behind a court’s seal on some vague notion that charges might be refiled if they can dredge any actual evidence?

More than a few windshields have been broken in this case. The public’s confidence in the system seems a tad cracked as well.

We need know what happened here.
