http://www.azleg.gov/legtext/53leg/1R/bills/HB2404P.htm Here are some parts of that HB 2404 which would make it almost impossible use paid signature collectors for a state wide initiatives written by citizens or people like us. 1) they will require people filing the initiative to be liable for any crimes committed by their paid petition circulatory. Each violation, by each person could cost you up to a $10,000 fine. 2) They will require a $50,000 bond for an initiative at the state wide level, i.e. laws that require 125,001 or more signatures. 3) people that are paid to circulate petitions will have to pay a registration fee and take an online class 4) It sounds like signature collectors are NOT allowed to be paid for each signature they collect like they are now paid. I'm not sure if this is true, but it sounds like the signature collectors will have to be paid by the hour, day, week or month. If that's true I suspect most initiatives couldn't afford to pay signatures collectors for the time they worked. 5) It looks like on a monthly basis you will have to give the Secretary of State all the petitions that have been collected by your paid signature collectors. For statewide initiative or referendum petitions that use paid circulators, the person or organization shall file with the secretary of state before obtaining signatures with paid circulators: (a) a signed and notarized affidavit declaring the following: (ii) The person or organization is liable for any violations committed by the paid circulators who collect signatures on behalf of the person or organization and the person or organization may be subject to a civil penalty as prescribed in subsection F of this section. (b) Evidence of a surety bond in a form acceptable to the secretary of state that is executed by the person or organization as principal and that is subject to claims against the person or organization for violations prescribed in subsection F of this section. The bond shall be CONTINUOUS in form, remain in effect while obtaining signatures with paid circulators and be in the minimum amount as follows: estimated paid signatures Minimum BOND not more than 25,000...................... $10,000 25,001 to 75,000.......................... $25,000 75,001 to 125,000......................... $35,000 125,001 or more........................... $50,000 SNIP F. For statewide initiative and referendum petitions only, if a court determines that a paid circulator has committed a civil or criminal violation relating to the registration, circulation or collection of signatures or petitions pursuant to this title on behalf of a person or organization that is circulating a statewide initiative or referendum petition, any violation by the paid circulator is deemed a violation by the person or organization and the person or organization is liable for a civil penalty of not to exceed ten thousand dollars for each violation by the paid circulator. SNIP The paid circulator shall pay a registration fee as determined by the secretary of state SNIP A person shall not pay or receive money or any other thing of value based on the number of signatures collected on a statewide initiative or referendum petition. For statewide petitions for initiative measures only, the committee that is the proponent of the initiative shall file with the secretary of state on the fifteenth day of each month all signatures collected in the immediately preceding calendar month by paid circulators who are required to register pursuant to section 19-118. |
