Hunter Osborn a football player at Red Mountain High School was charged with 69 counts of indecent exposure for whipping out his penis during his football teams photo shoot. Nobody noticed it, until the photos showed up in the schools yearbook.

Not a very "political correct" thing to do but we certainly shouldn't be paying the cops and prosecutors tens, if not hundred thousands of our tax dollars to prosecute some dumb *ss high school jock for whipping out his penis in the schools locker room during a photo shoot.

On the other hand if the cops didn't spend most of their times hunting down criminals for these petty, dumb *ss crimes they wouldn't have anything to do and would be out of their high paying jobs do nothing jobs.

I wonder if Jennifer White, the gun grabbing ACLU, atheist Democrat who doesn't like me because I am a Libertarian will be disagreeing with me 100% on this. She hates my statement where I said the government should not be throwing people in prison for consensual sex act when one person is 18 and the other person is 17.

Mesa police arrested a football player from Red Mountain High School on Saturday after reports that he had exposed himself in a football team picture published in the school yearbook.

According to police, Hunter Osborn, 19, said he was dared by a teammate to expose his penis when the team photo was taken in the school bleachers. That same team photo was put into the yearbook and team program.

The yearbook, which included the football team picture, was distributed before school officials were aware of the incident. The program had been sold at football games, authorities said.

Osborn was 18 at the time of the picture. He faces 69 counts of indecent exposure, based on the students and staff who were present when the photograph was taken, and one count of furnishing harmful items to minors, according to Mesa Police spokesman Steve Berry. He said the investigation is ongoing.

In a statement issued late Monday, Mesa Public Schools spokeswoman Helen Hollands said, "the district is dismayed by the actions of the students involved in the photograph. Their behavior does not reflect the values of Red Mountain High School or Mesa Public Schools."

Hollands said the yearbook has been recalled so the school can make the necessary edits to the picture.


Usually me and EJ Montini disagree 100%, but in this case we both seem to agree that is a waste of time for the Mesa cops to arrest a Red Mountain High School jock and charge him with 69 counts of indecent expose for whipping out his penis during a photo shoot for the school football team.

And even dumber thing is the Mesa cops didn't find out about it until months later, AFTER the year book was published. Neither did the idiots at Red Mountain High School.

On the other hand the do nothing, overpaid and under worked Mesa cops have to do something to justify their jobs.

The only thing that surprises me is the cops didn't charge him with 3,400 felony counts of sexual abuse of minors, because of the 3,400 Red Mountain High School students who saw the photo in their year book.

I think that here in Arizona if you show a child a dirty picture, that's legally considered "sexual abuse of a child". And on top of that the crime is considered just as bad as raping a child.

Mesa police arrested a football player from Red Mountain High School on Saturday after reports that he had exposed himself in a football team picture published in the school yearbook.

Red Mountain High School student Hunter Osborn did an incredibly stupid thing.

In the language of the court documents after his arrest he “exposed his penis through the top of his waistband of his football uniform pants during the photo session. The photo was placed into the yearbook which was distributed to the student body of approximately 3400 students."

How gross is the picture?

What's the picture look like without having to look at it?

Mesa Public Schools and Red Mountain sent out a press release saying, in part, that Osborn’s stunt “does not reflect the values” of the school or district – Gee, I hope not – and adding, "While the small size of the photograph as published makes the details difficult to discern, the yearbook has been recalled so the school can make a minor but critical edit for the inappropriate content."

So it’s a team photo taken from some distance.

Still, based on the photo and his own admissions, Osborn, now 19, was booked for 69 counts of indecent exposure -- class 1 misdemeanors -- and one count of furnishing harmful items to minors -- a class 4 felony.

69 misdemeanors and 1 felony -- is that fair?

Two things:

First, we all know high school boys are asinine and short-sighted. Legally, Osborn’s an adult, but none of us is so old that we’ve forgotten what dopes we were at his age. Still, it doesn’t excuse his behavior and whatever consequences Osborn suffers – no matter how severe or life-altering – they are his own stupid fault.

Second, the consequences he’s facing actually are too severe and life-altering.

And that’s our stupid fault.

We need to slow down and think this through.

Public humiliation is instantaneous and profound these days. Osborn’s lewd little escapade made the TV news, social media, websites, newspapers, radio. And it will be online to follow him and embarrass him and make his life more difficult…forever.

He may also get bounced from school.

Separating indecent from obscene

And while some criminal charges seem reasonable the 69 misdemeanors and a class 4 felony are too much. Osborn deserves to be disciplined, not persecuted.

What this kid did was indecent.

His punishment should not be obscene.


The cops and prosecutors who charged this guy with a felony for whipping out his penis during a photo shoot for his football team should be fired.

This is an outrageous waste of our tax dollars.

I can't see how the guy can be charged with indecent exposure because for the past two years since the photo was shot nobody noticed that the guys penis was hanging out of his pants. And even if somebody did, WHO CARES.

Police: Victims of indecent exposure by athlete could speak out to drop charges

Although a Mesa football player was booked on 70 counts related to a team photo that shows him exposing himself, the number of charges could be reduced or dropped, police and prosecution officials said.

Hunter Osborn, 19, was arrested Saturday. Officers said he told authorities he was dared by a Red Mountain High School teammate to do the stunt when the photo was taken on the school bleachers in August. It shows a smiling Osborn, then 18, standing in the second row; his penis was exposed through the top of the waistband of his football uniform.

Copies of the yearbook were distributed before school officials were aware of the revealing shot, and the photo was included in programs sold at football games in the fall, police said.

Mesa police booked Osborn on one count of furnishing obscene material to minors, a felony, and 69 counts of indecent exposure. Ten faculty members and 59 students were present when Osborn exposed himself and are considered victims, according to police and court documents.

Jerry Cobb, a spokesman with the Maricopa County Attorney's Office, said Tuesday that the office had received the recommended charges from Mesa police. The charges could be accepted, rejected or modified once the county attorney reviews the recommendation, Cobb said.

Mesa police spokesman Nik Rasheta said the number of potential counts could be altered if people present during the photo session speak out against their individual counts.

An individual could call the case agent, and if the person was 18 years old, could request that the misdemeanor charge be dropped on his or her behalf. Since some of the football players were minors, their parents or guardians could request a charge be dropped on their behalf, Rasheta said.

Rasheta said no one else would face charges in the matter.

Since Osborn's arrest was announced by Mesa police Monday, a stream of supportive tweets from students and adults using the #FreeHunter hashtag have protested the potentially life-changing charges against him. The general theme: It wasn't the smartest thing to do, and he has to take responsibility, but the charges seem excessive. Osborn told police he was "disgusted" by his actions, records state.

A Change.org petition created by user Alex Labban was launched Monday and had garnered more than 1,670 signatures by 6 p.m. Tuesday. It argues that responsibility for the distribution of the photo should fall on the school, not Osborn.

"Red Mountain High School is using him as a scapegoat instead of taking any responsibility," the page states. "Hunter needs to be held accountable for his actions but that doesn't mean ruining his life!"

Helen Hollands, a spokeswoman for Mesa Public School, said Tuesday that it was mandatory for school administrators to report the offense to police and that the district was pursuing its own disciplinary actions, which officials would not share.

Hollands added that only 250 copies, or 10 percent of the yearbooks, had been distributed to students on April 29. The majority still were in the school's possession, and staff members would be covering up the private area, she said.

It was "highly recommended" by the district that those who had received yearbooks return them temporarily so the photo could be edited, she said.

Hollands added that it was unlikely the yearbook staff would have been able to identify the minor but critical spot during a normal production review.

Red Mountain senior Erin Lambert, 17, said students were talking about how funny Osborn's prank was before any charges were recommended.

“I think he’s being punished too harshly, and that’s the general consensus I hear from everyone else at school," Lambert said. "I think he deserves to be punished, but the punishment here doesn’t fit the severity of his crime.”

Anthony May, a photographer whose work with Valley-based Southwest Portraits is featured in the senior and underclassman portraits, said he's worked with Red Mountain's student yearbook staff, which he said takes its work very seriously.

"It's always a quality product," May said. "It takes the yearbook adviser and the kids a lot of hours in getting it done during the year, and it's unfortunate it was tarnished by someone's joke."

May's studio didn't shoot the football-team photo, he said.

Osborn's next court appearance is scheduled May 16 at Maricopa County Superior Court's Southeast Regional Court Center in Mesa.

More than a few people have pointed this out.

So … yeah, the criminal charges are absurd.

Especially since even the school district admits that the yearbook photo wasn’t noticeable until the dope boasted about it on social media.

In a dream world where government works, the morons on the Mesa Police Department who had this kid charged with a felony for showing his dick at a high school photo shoot would be fired in.

The announcement came hours after a Maricopa County Attorney’s Office representative announced the office had decided against prosecuting the student. He had been booked on a felony charge related to exposing himself in a team photo that appeared in the school’s yearbook and in programs sold at football games.

A Mesa police spokesman said Wednesday that the case against Hunter Osborn, 19, was returned to police for further investigation but that the case would be closed.

“An assessment of the available evidence for the felony charge of furnishing harmful items to minors ... leads us to conclude that the evidence does not establish a violation of the statute,” Maricopa County Attorney Bill Montgomery said in a statement issued Wednesday.

Osborn was arrested Saturday. Officers said he told authorities he was dared by a Red Mountain High School teammate to do the stunt when the photo was taken on the school bleachers in August. It shows a smiling Osborn, then 18, standing in the second row; his penis was exposed through the top of the waistband of his football uniform.

Police said Wednesday the school's principal reported the incident in compliance with Arizona's mandatory reporting laws.

The Maricopa County Attorney’s Office brought some common sense, finally, to the case of the Red Mountain High School flasher.

In announcing that his office would not prosecute the felony charge against Hunter Osborn, Montgomery issued a statement reading: “An assessment of the available evidence for the felony charge of Furnishing Harmful Items to Minors, ARS 13-3506.A., leads us to conclude that the evidence does not establish a violation of the statute. MCAO has furthered review of remaining misdemeanor charges submitted by the Mesa Police Department for possible submittal to the Mesa City Prosecutor's Office.”

As I said in an earlier blog: No harm, no foul.

It's that simple. Or should be.

Now for the other 69 counts.

The "victims" of the Red Mountain High School kid who, on a stupid dare (Is there another kind?) exposed his penis through the top of the waistband of his football uniform for a team picture, can save Hunter Osborn from the ridiculous 70 criminal counts he's facing.

His punishment should be having to pay to fix the yearbook, where the photo appeared. (I'd guess that those who already have copies will be reluctant to return it to be fixed, thinking of it more as a quirky collectible that, years from now, will be laughed at.)

It should be that way.

Not every instance of such behavior is a crime.

Back in 1995, on a chilly February morning, a naked lady crossed Indian School Road, heading south on Seventh Street. She waited for the signal to turn green and the ''walk'' sign to appear. She looked both ways. She crossed. Sometime after that she was met by police officers. She wasn't taken to jail, but to a hospital.

Thousands of potential "victims" witnessed her indecent exposure as they passed by on their way to work. No charges were filed.

And that streaker at the Academy Awards

In 1974, a naked man "streaked" behind host David Niven at the 46th Academy Awards. There were probably a thousand or so "victims" in the audience and millions watching on TV.

The streaker was interviewed after the show. By TV news crews.

And the 250 'mooning' college students

A few years back 250 Stanford University students drop their trousers during a noontime rally on campus and in unison "mooned" the gathering crowd.

They were hoping to make the Guinness Book of World Records.

Authorities say that the students and teachers who were present for Osborn's stunt can contact authorities and denounce their victimhood.

Let the punishment fit the crime.

Perhaps a fitting penalty for Osborn would be to have all of "victims" gather as a group in front of the dopey exhibitionist ... and moon him.
