I talked to Alex today and he mentioned that in a Southern state (I think Arkansas) they allowed the legislator to pass laws setting rules and regulations in their marijuana initiative or maybe medical marihuana initiative. Alex said the legislator then passed laws setting outrageous million dollar insurance requirements and million dollar capital requirements for people that grow marijuana. And of course those regulations passed by the legislator for all practical purposes will then effectively make it impossible for the little guy to grow marijuana in that state. At one of our late night sessions at Tom Dean's house he added this sections. I was too tired to argument with it. I think we need to delete it. may only pass reasonable ordinances pertaining to the location and operation of a cannabis related business that are no more onerous or restrictive than existing zoning ordinances pertaining to the type of commercial activity that the business is engaged in, including, but not limited to retail, wholesale, agriculture, manufacturing, processing, distributing and storage.I'm sure in the eyes of our government masters who hate marijuana, REASONABLE means any thing they want which will effectively allow them to make marijuana illegal. And of course that is why this part of our initiative needs to be deleted. Now city government already CAN set zoning requirements for marijuana, but the zoning requirements have to apply to all other similar activities. So it's not like we are saying they can't pass zoning requirements. They just can't pass zoning requirements that are specifically aimed at marijuana.
